under U.S. and international copyright laws and are owned in their entirety by ShortCourses.com.
Unlike most publishers, we don’t impose strict digital rights
management software on our users because of the problems it causes. However, years of effort
and expenses have gone into these texts and multimedia components which are
sold at very low prices. To guide you we have set the
following conditions for the use of these materials and hope you find them fair to both the creators and users of our products.
When purchased at the school price,
the following terms and conditions apply to using this text:
- Each student in the class (the
Authorized User) must have their own copy of the publisher's distribution CD
which acts as their license agreement. If the CD doesn't belong to
you personally, if someone has previously used the same
CD, or if your disc is a copy, your disc is illegal by definition.
- Discs and their contents are not
sold, and ownership of them remains with the Publisher. Your
purchase of a CD is a user fee for an individual student. When a new class starts,
each student in that class must be provided
with their own copy of a new and previously uncirculated disc.
- Violation of these terms grants
the Publisher the right to block all on-line access to the
animations and other resources provided to Authorized Users.
- Authorized Users may use the text
but not copy, modify, transfer, or otherwise re-create any portion
of the content in whole or in part except as expressly permitted by
the Publisher.
- Authorized Users may make a
printout of the text for their own personal use but
printouts are not to be sold, loaned, or given away to others.
- Authorized Users and instructors can make a
personal backup copy but these copies cannot be shared or exchanged
with others.
- If you are an instructor, there
are no limitations on the number of students you can project the
materials for, or on the time period during which you can do it.
- Instructors should request
permission from the Publisher should they want to have multiple copies
printed locally.
- If you want to put the eTexts on a
network or shared computer, each and every user accessing the
on-line version must have a personal legal copy of the CD. The book
is not to be placed on any computer that students or others can
access without such a disc.
- The publisher has the rights to
request logs showing access to any on-line posting of the books and
be compensated for copies accessed by unauthorized users.
THE ETEXT IS FURNISHED ON AN “AS IS”
BASIS AND WITHOUT WARRANTY. THE LICENSOR EXPRESSLY DISCLAIMS ALL
WARRANTIES OF MERCHANTABILITY OR WARRANTIES OF FITNESS FOR A
PARTICULAR PURPOSE. THE LICENSOR SHALL NOT BE LIABLE FOR LOSS OF
PROFITS, LOSS OF USE, OR INCIDENTAL, CONSEQUENTIAL OR SPECIAL DAMAGES
THAT RESULT FROM THE USE OF THIS SOFTWARE, EVEN IF MADE EXPRESSLY
AWARE OF THE POSSIBILITY THEREOF
This agreement represents the entire
agreement between the Publisher and the Authorized User, and it
supersedes any proposals, communication, or prior agreements, oral or
written between said parties. If any of the provisions of this
agreement are invalid under any applicable statute or rule of law,
they are to that extent deemed omitted. This agreement will be
governed and construed as if wholly entered into and performed in the
Commonwealth of Massachusetts. You acknowledge that you have read this
agreement and agree to be bound by its terms and conditions.
